Terms of service
§1. Operator
The Richmilioner service (the "Service") is operated by [FILL IN: operator], [FILL IN: address], contact: [FILL IN: email] (the "Operator").
§2. What the service is
- The Service maintains a public ranking of nicknames ordered by the total amount of payments assigned to each nickname.
- A payment buys only the display of a nickname (and an optional message) in the ranking, at the position resulting from the total of payments. It grants no other rights, prizes, shares or benefits.
- The service is for entertainment. It is not a game of chance, a bet or a lottery - the order is decided solely by the total of payments.
- A position in the ranking is not permanent: other users may pay more and move an entry down.
§3. Ranking rules
- Payments under the same nickname add up, regardless of who made them. Letter case and extra spaces do not matter.
- The displayed spelling of a nickname comes from the first payment under that nickname.
- A nickname shows the message from its largest single payment that included a message.
- If totals are equal, the nickname that reached the total first ranks higher.
- The Service maintains a global ranking and rankings for individual countries. Each nickname is assigned to the country chosen with the first payment under that nickname; the country is shown as a flag next to the nickname. A country ranking includes only nicknames assigned to that country.
- The country is declared by the user and is not verified.
- Each ranking shows the top 100 positions. The Service also publishes aggregate statistics (totals, records, latest payments) based on the same data.
§4. Payments and currencies
- Payments are processed by Stripe. The Operator does not receive or store payment card data.
- Payments can be made in any of the currencies offered by the Service. The amount is charged exactly in the selected currency; any currency conversion fees charged by the payer's bank or card issuer are borne by the payer.
- For the purposes of the ranking, each payment is converted into Polish zloty (PLN) at the European Central Bank reference rate applicable when the payment is initiated. This rate is recorded with the payment and does not change later.
- Amounts shown in the Service in other currencies are for information only and are converted at current rates.
- The minimum payment is the equivalent of PLN 5 and the maximum is the equivalent of PLN 100,000 (lower in some currencies due to payment processor limits).
- An entry appears in the ranking as soon as Stripe confirms the payment.
§5. Right of withdrawal
- The service is performed immediately after the payment is confirmed.
- Before paying, a user who is a consumer requests the performance of the service to begin before the withdrawal period expires and acknowledges that they lose the right of withdrawal once the service has been performed.
§6. User content
- Nicknames, messages and countries are public. Content that is unlawful, offensive, vulgar, hateful, impersonates others, contains third parties' personal data, advertising or links is prohibited.
- The Operator may anonymise a nickname or message that breaches these terms (the entry stays in the ranking as "Anonymous" and its payments still count) or, in the case of a serious breach, remove the entry from the ranking.
§7. Reporting illegal content
- Anyone can report content they consider illegal or in breach of these terms by writing to [FILL IN: email]. A notice should state the nickname concerned, the reasons, the notifier's contact details and a statement that the notice is submitted in good faith.
- The Operator handles notices promptly, diligently and without automated decision-making, and informs the notifier of its decision.
- If the Operator restricts content, it provides the author of the entry (where it can contact them) with a statement of reasons and information on how to appeal at [FILL IN: email].
- The point of contact for users and EU Member State authorities under the Digital Services Act (DSA) is [FILL IN: email]; we correspond in Polish and English.
§8. Refunds and chargebacks
If a payment is refunded or disputed with the card issuer (chargeback), its amount no longer counts towards the nickname's total.
§9. Complaints
Complaints can be sent to [FILL IN: email]. The Operator responds within 14 days of receiving a complaint.
§10. Personal data
How we process personal data is described in the privacy policy.
§11. Final provisions
- Polish law applies to matters not covered by these terms. This choice of law does not deprive consumers of the protection afforded by the mandatory provisions of the law of their country of habitual residence.
- These terms are available in Polish and English. In case of discrepancies, the Polish version prevails.
- The Operator may change these terms for important reasons - changes do not apply to payments made earlier.
